1. Rental Agreement
1.1 The rental agreement (hereinafter referred to as the “Agreement”) between M-Rent S.r.l., with registered office in Trento, at Via G. Grazioli, 106, VAT number 02698820228 (hereinafter referred to as “M-Rent”), and the Customer, consists of the Specific Rental Conditions and these General Rental Conditions, which the Customer declares to have carefully read – before signing – and fully accepts.

2. Rental Requirements
2.1 Rental is not allowed for customers under the age of 19 or over the age of 85.
2.2 Customers aged between 19 and 21 can only rent vehicles in Category A or B (see specific Category specifications at the end of these General Conditions, Table 1).
2.3 For customers under the age of 25 or over the age of 75, a daily surcharge is applied, as indicated in the specific Category specifications at the end of these General Conditions (Table 1) and in the Specific Rental Conditions.
2.4 The Customer must possess a valid driver’s license issued at least 12 months prior to the rental start date and be the holder of a credit card – not prepaid or virtual – with an expiration date at least six months after the end date of the rental period. The driver’s license and ID card must be presented in their original form at the time of vehicle delivery.
2.5 If the Customer is not a resident of Italy, the driver’s license must be valid for driving in Italy, and the Customer must also present the passport in its original form at the time of vehicle delivery. If necessary, the Customer must also possess an international driving permit. The license must be in Latin characters or, if not, accompanied by a certified translation.
2.6 In the absence of any of these requirements, the vehicle will not be delivered, and the Agreement shall be considered terminated due to the Customer’s non-compliance, even in the case of prepaid rentals. In such cases, M-Rent reserves the right to retain the received payment permanently and seek compensation for any additional damages.
2.7 The assignment of the contract by the Customer is prohibited.

3. Security Deposit and Delayed Charge Authorization on Credit Card
3.1 At the same time as signing the Agreement, the Customer must provide a security deposit to M-Rent by charging it to a credit card or, at M-Rent’s discretion, by pre-authorizing the charge on the same credit card, as a guarantee for the accurate fulfillment by the Customer of all obligations arising from the provisions of the Agreement or the law.
3.2 The amount of the deposit varies depending on the vehicle category and is specified in the specific Category specifications at the end of these General Conditions (Table 1) and in the Specific Conditions.
3.3 The deposit will be refunded – possibly by releasing the pre-charged amounts – following the return of the vehicle, net of any charges for damages of any kind caused to the vehicle or other attributable to the Customer for any reason.
3.4 The Customer is aware and accepts that, despite M-Rent’s immediate release of the pre-charged amounts (except for charges specified in the preceding Article 3.3), the actual availability of the respective amounts on the Customer’s credit card depends on the payment circuit’s operation, over which M-Rent has no control.
3.5 By signing the Agreement, the Customer also irrevocably authorizes M-Rent to charge – even after the return of the vehicle and the refund of the aforementioned security deposit – on the credit card used to provide the security deposit, one or more amounts corresponding to the costs of any damages ascertained at any time by M-Rent and/or any charges of any nature received by M-Rent during or after the rental period (e.g., for traffic violations, highway tolls, parking fees, etc.) due to the Customer’s responsibility and/or costs for the administrative management of such practices by M-Rent.

4. Vehicle Delivery
4.1 M-Rent delivers to the Customer a vehicle in excellent condition, complete with all the necessary equipment, including legal and usage documents (emergency parking triangle, tools, high-visibility vest, spare tire or tire repair kit, vehicle registration certificate, insurance certificate and sticker, green card, as well as all other accessories listed in the check-out/in forms).
4.2 The vehicle belongs to the Category chosen by the Customer or, at M-Rent’s discretion, to a higher Category, in which case no additional fees are applied to the Customer (see specific Category specifications at the end of these General Conditions, Table 1).
4.3 Any notes regarding the condition of the vehicle are specified in the Specific Rental Conditions and/or in the check-out/check-in forms.
4.4 The Customer must carefully inspect the vehicle at the time of delivery and report any discrepancies and/or damages on the vehicle to M-Rent strictly before using it. Discrepancies and/or damages present at the time of delivery must be recorded in the Specific Rental Conditions and/or in the check-out forms.
4.5 The Customer is responsible for any damages and/or discrepancies found on the vehicle at the time of return and not recorded (as pre-existing) in the Specific Rental Conditions and/or in the check-out form, as specified in the previous paragraph.

5. Vehicle Use
5.1 The vehicle must be used with the utmost care and diligence.
5.2 Driving is only allowed for the designated driver or drivers specified in the Specific Rental Conditions.
5.3 The use of the vehicle is prohibited:

• for transporting passengers in exchange for payment or for sub-renting purposes;
• for transporting goods in exchange for payment (except for vans intended for such use);
• for towing or pushing other vehicles, trailers, or other objects;
• off-road, on unpaved or closed roads, or on roads unsuitable for the vehicle;
• when overloaded or with improperly secured loads;
• for transporting any item or substance that, due to its condition (including odor), may damage the vehicle and/or hinder the possibility of re-rental;
• for participating in races, tests, competitions, or other similar events;
• in restricted areas;
• for driving lessons;
• in violation of the driving requirements;
• in general, in violation of any provisions of the Highway Code related to vehicle driving and/or driver behavior or any other legal provisions and/or regulations.

5.4 Smoking inside the vehicle is prohibited. If there is a smell of smoke upon the return of the vehicle, the Customer will be charged €150.00 for interior cleaning, without prejudice to the compensation for any additional damages.
5.5 The Customer is authorized to drive only in Italy. Travel to other countries is allowed only with the written authorization from M-Rent.
5.6 The Customer must ensure that the vehicle, when not in use, is parked in a safe, sheltered place, locked, and with all safety devices activated.
5.7 Any repairs, regardless of who performs them, are prohibited. If any repair, of any kind, is necessary, the Customer must immediately contact M-Rent and follow the instructions provided.
5.8 M-Rent is not responsible towards the Customer, authorized drivers, or any third parties for any personal injury and/or loss or damage to personal belongings left in the vehicle during or after the rental period.
5.9 Any items present in the vehicle at the time of return will be considered abandoned.
5.10 In addition to any further rights held by M-Rent, improper use of the vehicle results in the immediate forfeiture of the liability limitations mentioned in Article 8.1, as well as any Easy Cover, Special Cover, and Privilege Cover purchased (see Article 8)

6. Vehicle return
6.1 The Customer undertakes to return the vehicle in the same condition in which it was delivered, except for normal wear and tear for the agreed-upon use, with all documents and onboard accessories, at the place, date, and time indicated in the Specific Conditions.
6.2 Upon return, M-Rent will inspect the condition of the vehicle in the presence of the Customer, who is required to participate in the verification process and report any events that occurred during the rental period (such as accidents, malfunctions, traffic violations, etc.).
6.3 The outcome of the inspection will be recorded in the check-in form, which the Customer agrees to sign upon completion of the process.
6.4 If the Customer fails to participate in the verification process upon return or refuses to sign the check-in form, they accept in advance the outcome of the inspection carried out by M-Rent in their absence, waiving any disputes. In such cases, any damages must be reported to the customer within 10 days. The Customer has the right to have their own statements recorded in the check-in form.
6.5 In the event of early return of the vehicle before the agreed rental period ends, no refund is provided for the unused rental period.

7. Payment terms
7.1 The rental fee (base rate) is indicated in the Specific Conditions, which also specify whether the rate includes unlimited mileage or not. In the latter case, the daily allowance of kilometers without additional charge is stated, and any excess mileage will incur an additional fee calculated by multiplying the number of excess kilometers by the specified extra cost per kilometer, also mentioned in the Specific Conditions.
7.2 In addition to the base rate, the Customer is obliged to pay M-Rent for additional services – described in these General Conditions and listed in the Specific Conditions if purchased – as well as any additional costs and penalties indicated in the corresponding tables at the end of these General Conditions (Table 2).
7.3 Charges are calculated on a daily basis, with a day defined as a period of 24 hours starting from the vehicle delivery time and date to the Customer. A maximum tolerance of 29 minutes is allowed, beyond which an extra day of rental will be charged.
7.4 The vehicle must be returned with the same amount of fuel as indicated in the Specific Conditions at the time of delivery. In case of return with less fuel, the costs for the missing fuel – specified in these General Conditions (Table 2) – as well as a fixed amount for refueling will be charged.
7.5 Any damages to the vehicle will be charged based on the corresponding technical estimate conducted by M-Rent and quantified according to the “Damage Table” at the end of these General Conditions (Table 3), which also indicates the related administrative management costs borne by the Customer. Damages are estimated using specific software, manufacturer price lists, repair times, and include labor costs, consumables, and waste disposal.

8. Insurance and additional guarantees
8.1 The base rental rate includes mandatory third-party liability insurance (RCA – Basic) with a coverage limit not lower than the legal minimum, as well as a limitation of liability in favor of the Customer in case of vehicle damage or theft. Under this limitation, the Customer is responsible for damages or theft up to the following maximum amounts, except as provided in subsequent paragraphs and articles
